1. Scope of These Terms and Conditions
These Terms and Conditions are applicable to your access to and use of www.tevixMD.com, all tevixPAY Platforms (including mobile platforms), tevixPAY and the Patient Payment Portals and all other websites and online applications operated by Laboratory Corporation of America Holdings or its affiliates and subsidiaries, including Laboratory Corporation of America (collectively, "tevixMD," “we,” “our,” “us”) that link to or incorporate these Terms and Conditions (the “Online Services”). Please read these Terms and Conditions carefully. Your access to and use of the Online Services and the information, materials, products, tools, and services available through the Online Services are subject to these Terms and Conditions, regardless of whether you possess or do not possess an account through the Online Services linked to your name and/or contact information (“Account”). By accessing or using the Online Services, you acknowledge that you understand and agree to be bound by these Terms and Conditions. If you do not understand or agree to be bound by these Terms and Conditions, do not access or use the Online Services.
When you use certain of the Online Services (e.g., tevixMD®: Patient Payment Portal, tevixPAS®, etc. ), we may provide you with additional terms and conditions relating to that specific Online Service, which will supplement the generally applicable terms of these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions and any Online Service-specific terms and conditions, the Online Service-specific terms conditions shall govern with respect to your access to and use of that Online Service.
2. Privacy Statement and Notice of Privacy Practices
Our Privacy Statement and, with respect to protected health information, our Notice of Privacy Practices describe how tevixMD collects information about you through the Online Services, and how we use, disclose, and protect that information.
3. Disclaimer of Content
The Online Services provide information about our company and selected subsidiaries, and the products and services offered by each of them, including diagnostic health testing and services, data analysis, clinical trials capabilities, employer health management solutions, and information about various health conditions.
The clinical information contained within the "Health Care Provider" section of www.tevixMD.com is intended for the use of health care professionals. Health care providers should exercise their own clinical judgment when using our content, tools, or databases.
If you are a patient or health care consumer, you should not use information found on the Online Services to replace a relationship with your physician or other health care professional and should not rely on that information as professional medical advice. Always seek the advice of your physician or other qualified health care provider concerning questions you have regarding a medical condition, and before starting, stopping, or modifying any treatment or medication. In the case of a health emergency, seek immediate assistance from emergency personnel. Never delay obtaining medical advice or disregard medical advice because of something you have or have not read on the Online Services.
The information (including, without limitation, advice and recommendations) and services on the Online Services are intended solely as a general educational aid and are neither medical nor health care advice for any individual problem nor a substitute for medical or other professional advice and services from a qualified health care provider familiar with your medical history. Use of the Online Services does not create a doctor-patient relationship. No information contained in the Online Services is intended to be used for medical diagnosis or treatment. You acknowledge and agree that we have not represented that content provided through the Online Services has the ability to diagnose disease, prescribe treatment, or perform any other tasks that constitute the practice of medicine.
While tevixMD attempts to keep all the information on the Online Services up-to-date, medical treatment and knowledge change quickly, and the Online Services should not be considered error-free or as a comprehensive source of all information on a particular topic. tevixMD makes no warranties or representations as to the accuracy of the content of the Online Services, and assumes no responsibility for any consequences relating directly or indirectly to any action or inaction you take based upon the information and material on the Online Services. Your use of the Online Services is subject to the additional disclaimers and caveats that may appear throughout these Terms and Conditions and the Online Services. You assume the entire risk of loss in using the Online Services and materials contained in the Online Services.
Features and specifications of products or services described or depicted on the Online Services are subject to change at any time without notice.
Certain of the information about health conditions on the Online Services is provided by third parties including, but not limited to, the patient Health Library, with content provided by Lab Tests Online®, which is published by the American Association for Clinical Chemistry (AACC). The AACC has not reviewed and does not endorse any information, products, or services other than those clearly marked as being from Lab Tests Online.
4. Copyright, Trademarks and other Intellectual Property
Copyright, trademark, patent, and other applicable laws protect the services and materials appearing on the Online Services. All materials on the Online Services may be accessed, downloaded, or printed for the noncommercial purpose of scientific or educational advancement or within the scope allowable by these Terms and Conditions. No other use of these materials may be made without express written permission of the operators of tevixMD. Any unauthorized use of the words or images on the Online Services may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statutes.
The Online Services include material that is derived in whole or in part from materials that are copyrighted, including the format and layout of the Online Services. The copyrights are owned by tevixMD, or for licensed content, the content providers.
The Online Services are owned by Laboratory Corporation of America Holdings. None of the names, trademarks, service marks and logos of tevixMD appearing on the Online Services may be used in any advertising or publicity, or otherwise to indicate tevixMD's sponsorship of or affiliation with any product or service, without express written permission of the operators of tevixMD. Nothing contained on the Online Services should be construed as granting, by implication, estoppel, waiver or otherwise, any license or right of use to any trademark displayed on the Online Services without the written permission of the owners and operators of tevixMD or the third party owner of the trademark, if any. The Online Services may contain other proprietary notices and copyright information, the terms of which must be observed and followed.
5. Right to Change Terms and Conditions
tevixMD may, at any time and from time to time, change these Terms and Conditions, in whole or in part. You agree to review these Terms and Conditions periodically. Any changes to these Terms and Conditions will be effective immediately upon the posting of the modified Terms and Conditions to the Online Services, and, if you possess an Account, by either providing notice of the changes to you when you log in to the Online Services or by sending notice of the changes to contact information that you have provided to us. You agree to comply with, and be bound by, the modified Terms and Conditions either (i) by continuing to use or access the Online Services after modified Terms and Conditions are posted to the Online Services, or (ii) if you possess an Account, by not requesting to terminate your Account within seven (7) calendar days after receiving a notice of the changes as described above.
6. Your Provision of Contact and Account Information to Us
When you provide information about yourself to us, including when you create an Account, you agree to: (a) provide accurate, current, and complete information about yourself, and not to provide information that attempts to impersonate another individual; and (b) maintain and promptly update such information to keep it accurate, current, and complete. If you provide any information that is untrue, inaccurate, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we retain the right to suspend or terminate any Account you establish and/or to refuse any or all current or future use of the Online Services or any portion thereof.
7. Use of the Online Services by Health Care Providers and Health Plans
If you are a health care provider or a health plan, you represent and warrant that when using the Online Services you will comply with all applicable laws and regulations, including the Health Insurance Portability and Accountability Act and its implementing regulations and other federal and state privacy and data security laws, and you will not provide any information, including protected health information, to us for which you do not have the required authorizations or consents.
8. User-Provided Content
You understand that all information, data, or other materials that you and other users of the Online Services upload, post, transmit, publish, display, or otherwise make available through the Online Services, including information you share with or make available to other users of the Online Services ("User-Provided Content"), are the sole responsibility of you or the person from whom such User-Provided Content originated. This means that you, and not us, are responsible for all User-Provided Content that you upload, post, transmit, publish, display, or otherwise make available through the Online Services. We do not control the User-Provided Content posted and, as such, do not guarantee the accuracy, integrity, or quality of any User-Provided Content. Furthermore, the User-Provided Content is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. You understand that by using the Online Services, you may be exposed to User-Provided Content that is offensive, indecent, or objectionable. Under no circumstances will we be liable in any way for or related to any User-Provided Content, including, but not limited to, for any errors or omissions in any User-Provided Content, or for any loss or damage of any kind incurred as a result of the publication or use of or reliance on any User-Provided Content uploaded, posted, transmitted, published, displayed, or otherwise made available through the Online Services.
By uploading, posting, transmitting, publishing, displaying, or otherwise making available User-Provided Content through the Online Services, you represent and warrant that:
you own or control all rights, title, and interests to such User-Provided Content;
all "moral rights" that you may have in such User-Provided Content have been voluntarily waived by you;
you have the right to grant the licenses granted under these Terms and Conditions;
all User-Provided Content that you post: (i) is accurate; (ii) does not violate these Terms and Conditions; (iii) will not conflict with, result in a breach or violation of any terms or provisions of, or constitute a default under any contract or agreement to which you are currently bound or will become bound in the future; (iv) does not and will not violate any law, and (v) will not cause injury to any person or entity; and
you are at least 13 years old.
9. Your Grant of License to tevixMD for User-Provided Content
By uploading, posting, transmitting, publishing, displaying, or otherwise making available User-Provided Content, you grant us a worldwide, perpetual, non-exclusive, royalty-free license (with the right to sub-license) to use, reproduce, display, perform, adapt, modify, publish, create derivative works from, or distribute such User-Provided Content in whole or in part in any form, medium, or technology (now known or later developed) without compensation to you, including but not limited to, in any unaffiliated third party content and in our or their publications, marketing material, and advertisements. We may modify or adapt User-Provided Content, including in order to transmit, display, or distribute it over networks and to conform to the requirements of networks, services, or other media. We or others may, in our sole discretion, cite to your name or other identifier you provided when posting User-Provided Content. You represent and warrant that our publication and use of your User-Provided Content will not infringe or violate the intellectual property or other rights of any third party.
This Section 9 does not apply to any protected health information that you upload, post, transmit, publish, display, or otherwise make available through the Online Services.
10. tevixMD's Discretion to Use User-Provided Content
User-Provided Content that you upload, post, transmit, publish, display, or otherwise make available through the Online Services may be used by tevixMD in accordance with our Privacy Statement and, with respect to protected health information, our Notice of Privacy Practices tevixMD reserves the right to change, condense, delete, or refuse to post any User-Provided Content on the Online Services in its sole discretion. None of the User-Provided Content that you submit shall be subject to any obligation of confidence on the part of tevixMD, its agents, partners, or third-party service providers and their respective directors, officers, and employees.
11. Your Conduct
You agree to comply with all laws, rules, and regulations applicable to your use of the Online Services. In addition, you agree not to:
upload, post, email, transmit, or otherwise make available any User-Provided Content that is known by you to be false, inaccurate, or misleading;
upload, post, email, transmit, or otherwise make available any User-Provided Content that violates any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising);
upload, post, email, transmit, or otherwise make available any User-Provided Content that is, or may reasonably be considered to be, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that harms minors in any way;
forge headers or otherwise manipulate identifiers in order to disguise the origin of any User-Provided Content transmitted in connection with the Online Services;
upload, post, email, transmit, or otherwise make available any User-Provided Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
upload, post, email, transmit, or otherwise make available any User-Provided Content that infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;
upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
take any action that interferes with the proper working of the Online Services, compromises the security of the Online Services, or otherwise damages the Online Services or any materials and information available through the Online Services
attempt to gain unauthorized access to any portion or feature of the Online Services, to any other systems or networks connected to the Online Services, to any of our servers, or to any of the services offered on or through the Online Services, including but not limited to by hacking, password “mining”, or any other unauthorized means;
probe, scan, or test the vulnerability of the Online Services or any network connected to the Online Services or bypass the authentication measures on the Online Services or any network connected to the Online Services;
use any automated means to collect information or content from or otherwise access the Online Services, including but not limited to through the use of technical tools known as robots, spiders, or scrapers, without our prior permission;
harvest or otherwise collect and store information about other users of the Online Services, including e-mail addresses;
install any software, file, or code that is not authorized by the user of a computer or mobile device or that assumes control of all or any part of the processing performed by a computer or mobile device without the authorization of the user of the computer or mobile device; or
interfere with or disrupt the operation of the Online Services or server networks connected to the Online Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Online Services.
12. Third Party-Owned Content and Links to Third Party Owned-Websites or Online Applications
The Online Services may contain third party-owned content (e.g., articles, data feeds, abstracts, etc.) and may also include hypertext links to third party-owned websites and online applications. We provide such third party-owned content and links as a courtesy to our users. We have no control over any third party-owned websites or online applications or third-party owned content referenced on, linked to from, accessed by, or available on the Online Services and, therefore, we do not endorse, sponsor, recommend, or otherwise accept any responsibility for such third party-owned websites or online applications (or the availability of such websites or online applications) or third-party owned content. IN PARTICULAR, WE DO NOT ACCEPT ANY LIABILITY ARISING OUT OF ANY ALLEGATION THAT ANY THIRD PARTY-OWNED CONTENT (WHETHER PUBLISHED ON THE ONLINE SERVICES, OR ANY OTHER WEBSITE OR ONLINE APPLICATION) INFRINGES THE INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON OR ANY LIABILITY ARISING OUT OF ANY INFORMATION OR OPINION CONTAINED IN SUCH third-party owned content OR ON ANY THIRD PARTY-OWNED website or online application LINKED TO FROM THE ONLINE SERVICES.
13. Links to the Online Services
You should not link to the Online Services, nor use tevixMD's name, trademark, logos, or otherwise refer to tevixMD in any public communications without first obtaining tevixMD's advance written consent. Requests to link to the Online Services or use tevixMD's name should be directed to tevixMD Marketing Relations
14. Advertising and Sponsorships
We do not accept paid advertisements or sponsorships on the Online Services.
15. Information, News, and Press Releases
The Online Services may contain information about tevixMD, such as news and press releases. You acknowledge that we have no duty or obligation to maintain the accuracy of, or update any such information, and agree that your reliance on any such information is at your own risk.
16. Registration and Passwords
The Online Services may permit or require you to register or obtain a password prior to permitting you to access certain portions of the Online Services. You acknowledge and agree that you are responsible for maintaining the confidentiality of your login ID and password, and for all uses of your login ID, password, and/or Account. You agree to notify us immediately of any unauthorized use of your login ID, password, or Account, or any other breach of security involving access to the Online Services through your Account. You acknowledge that you may be held liable for any loss or harm incurred by us or any other person or entity due to someone else using your login ID, password, or Account as a result of your failing to keep your Account information secure and confidential.
17. Operation of the Online Services
We reserve the right to do any of the following, at any time, at our sole discretion, with or without notice: (i) modify, suspend, or terminate operation of or your access to the Online Services, or any portion of the Online Services, including but not limited to for your violation of these Terms and Conditions; (ii) modify or change the Online Services, or any portion of the Online Services; and (iii) interrupt the regular operation of the Online Services, or any portion of the Online Services, as necessary to perform routine or non-routine maintenance, to correct errors, or to make other changes to the Online Services.
18. Disclaimer of Warranty; Limitation of Liability
THE ONLINE SERVICES AND ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, TOOLS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE ONLINE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TEVIXMD AND ITS SUPPLIERS DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES WITH REGARD TO THE ONLINE SERVICES AND ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, TOOLS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE ONLINE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE ONLINE SERVICES WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS.
You agree to indemnify, defend, and hold harmless tevixMD and its suppliers, and their respective affiliates, subsidiaries, employees, officers, directors, agents, contractors, servants, insurers, and representatives from any liability, loss, claim, suit, damage, judgment and expense (including reasonable attorneys´ fees and expenses) that arise out of or are related to any User-Provided Content you submit, post, transmit, or make available through the Online Services, your violation of these Terms and Conditions, your use or misuse of the Online Services, or your violation of any third-party rights.
If any provision of these Terms and Conditions is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of these Terms and Conditions shall remain in full force and effect. Any provision of these Terms and Conditions held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable. The parties further agree to replace such invalid or unenforceable provision of these Terms and Conditions with a valid and enforceable provision that will achieve, to the extent possible, the economic, business, and other purposes of such invalid or unenforceable provision.
21. Applicable Law
These Terms and Conditions and the resolution of any dispute related to these Terms and Conditions shall be construed in accordance with the laws of the State of North Carolina. Any dispute between tevixMD and you related to these Terms and Conditions shall be resolved exclusively by the state and federal courts of the State of Delaware.
The Online Services can be accessed from the United States and other countries worldwide. Since the laws of each State or country may differ, you agree that the statutes and laws of the State of Delaware, without regard to any principles of conflicts of law, will apply to all matters relating to your access to or use of the Online Services.
tevixMD makes no representation that material on the Online Services is appropriate or available for use in other locations, and accessing this information from territories where the content is illegal is prohibited. Those who choose to access the Online Services from other locations do so by their own initiative and are responsible for compliance with local laws.
These Terms and Conditions are effective unless and until modified as noted above, or terminated, at any time, by tevixMD.

Laboratory Corporation of America Holdings and its subsidiaries, including Laboratory Corporation of America (collectively "tevixMD"), is a national clinical laboratory that fully embraces genomic and molecular testing and has pioneered new diagnostic technologies. tevixMD is committed to protecting the privacy of every person who visits the tevixMD website so that each person will feel free to gather information, make inquiries/comments, and/or perform bill payment functions on our site. As part of tevixMD's effort to protect the privacy of your personal information while visiting the tevixMD site, we created this web privacy statement to inform you of the privacy standards used to ensure the security and confidentiality of your information. The following information details how tevixMD uses information that you provide to us via the tevixMD website and answers commonly asked questions regarding the privacy of your individual information.
What personal information does tevixMD collect?
tevixMD does not ask you to provide personal health care information to us through our general website.* We obtain personally identifying information about you only if you voluntarily choose to provide such information via correspondence with tevixMD. Feedback forms used in tevixMD correspondence specifically request that you not include personal information such as user names, passwords, social security numbers, and private health information. Correspondence conducted via tevixMD feedback forms is stored on a third-party server and then downloaded by tevixMD personnel.
* If you are a user of tevixMD Beacon: Patient; Beacon LBS; Appointment Scheduling; or other specific tevixMD programs, you may be asked to provide personal information through those applications. In addition to the general applicability of this Web Privacy Statement to those products, use of those applications and any information collected there through, are governed by specific end user agreements, as well as tevixMD's Notice of Privacy Practices relating to use and disclosure of individually identifiable health information.
Various tevixMD webpages and programs give users the option to make electronic payment for services. Information from these bill payment links do not display or transmit any personal health care information about you or from your account. LatevixMDbCorp utilizes the services of ACI, an independent third party in processing payment information.
How does tevixMD protect the security of your information?
Financial information and payment data, including credit card numbers, that you provide to us via the tevixMD internet bill payment link is encrypted by using secure socket layer (SSL) encryption technology, which employs a 128-bit encryption system. This information may be accessed only by tevixMD employees who maintain password and job-required access rights, and third party vendors who support tevixMD's billing operations. Additionally, tevixMD maintains all personal patient data within the tevixMD information system (IS) firewalls that operate on separate tevixMD mainframes/servers. The general public may not access these mainframes/servers.

Facebook Tracking Tools on tevixMD Pixel Pages
On the Pixel portion of our website, we use the visitor action pixels of Facebook Inc. (1 Hacker Way, Menlo Park, CA 94025, USA). These pixels enable us to track what website users do after they click on a Facebook advertisement, so we can assess the effectiveness of Facebook ads for statistical and market research purposes. The data we get from this tracking doesn’t identify any individual website users. Facebook itself, however, stores the tracking data and may link it to your Facebook account. Facebook also may use the tracking information for its own promotional purposes, in accordance with Facebook’s Data Usage Policy https://www.facebook.com/about/privacy/. A cookie may be stored on your computer for these purposes.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice of Privacy Practices applies to Laboratory Corporation of America Holdings and all of its subsidiaries and business units (collectively referred to as "tevixMD" in this Notice), except to the extent that a subsidiary, division, or business unit of tevixMD performs occupational screening, forensic tests, paternity/identity tests, clinical trials tests or other services that do not involve standard electronic transactions for which the Department of Health and Human Services (“HHS”) has adopted standards.
tevixMD's Protection of Protected Health Information (PHI)
Under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), tevixMD is required by law to maintain the privacy of health information that identifies you, called protected health information (PHI), and to provide you with notice of our legal duties and privacy practices regarding PHI. tevixMD is committed to the protection of your PHI and will make reasonable efforts to ensure the confidentiality of your PHI, as required by statute and regulation. We take this commitment seriously and will work with you to comply with your right to receive certain information under HIPAA.
tevixMD's Use and Disclosure of PHI
As permitted under HIPAA, the following categories explain the types of uses and disclosures of PHI that tevixMD may make. Some of the uses and disclosures described may be limited or restricted by state laws or other legal requirements, for example, the Clinical Laboratory Improvement Amendments of 1988 (CLIA). Please contact our Privacy Officer, using the contact information provided at the end of this notice, for specific information regarding your state.
For treatment - tevixMD may use or disclose PHI for treatment purposes, including disclosure to physicians, nurses, medical students, pharmacies, and other health care professionals who provide you with health care services and/or are involved in the coordination of your care, such as providing your physician with your laboratory test results.
For payment - tevixMD may use or disclose PHI to bill and collect payment for laboratory or genetic counseling services we provide. For example, tevixMD may provide PHI to your health plan to receive payment for the health care services provided to you.
For health care operations - tevixMD may use or disclose PHI for health care operations purposes. These uses and disclosures are necessary, for example, to evaluate the quality of our laboratory testing, accuracy of results, accreditation functions and for tevixMD's operation and management purposes. tevixMD may also disclose PHI to other health care providers or health plans that are involved in your care for their health care operations. For example, tevixMD may provide PHI to manage disease, or to coordinate health care or health benefits.
Appointment reminders and health-related benefits and services - tevixMD may use and disclose PHI to contact you as a reminder that you have an appointment with us and may use and disclose PHI to tell you about health-related benefits and services that may be of interest to you. For example, tevixMD may contact you about a new patient service center in your area or about new testing services available at tevixMD based on services ordered by your physician.
Individuals involved in your care or payment for your care - tevixMD may disclose PHI to a person who is involved in your care or helps pay for your care, such as a family member or friend. We also may notify your family about your location or general condition or disclose such information to an entity assisting in a disaster relief effort. As allowed by federal and state law, we may disclose the PHI of minors to their parents or legal guardians.
Business associates - tevixMD may disclose PHI to its business associates to perform certain business functions or provide certain business services to tevixMD. For example, we may use another company to perform billing services on our behalf. All of our business associates are required to maintain the privacy and confidentiality of your PHI. In addition, at the request of your health care providers or health plan, tevixMD may disclose PHI to their business associates for purposes of performing certain business functions or health care services on their behalf. For example, we may disclose PHI to a business associate of Medicare for purposes of medical necessity review and audit.
Disclosure for judicial and administrative proceedings - Under certain circumstances, tevixMD may disclose your PHI in the course of a judicial or administrative proceeding, including in response to a court or administrative order, subpoena, discovery request, or other lawful process.
Law enforcement - tevixMD may disclose PHI for law enforcement purposes, including reporting of certain types of wounds or physical injuries or in response to a court order, warrant, subpoena or summons, or similar process authorized by law. We may also disclose PHI when the information is needed: 1) for identification or location of a suspect, fugitive, material witness or missing person, 2) about a victim of a crime, 3) about an individual who has died, 4) in relation to criminal conduct on tevixMD premises, or 5) in emergency circumstances to report a crime, the location of the crime or victims, or the identity, description, or location of the person who committed the crime.
As required by law - tevixMD must disclose your PHI if required to do so by federal, state, or local law.
Public Health - tevixMD may disclose PHI for public health activities. These activities generally include: 1) disclosures to a public health authority to report, prevent or control disease, injury, or disability; 2) disclosures to report births and deaths, or to report child abuse or neglect; 3) disclosures to a person subject to the jurisdiction of the Food and Drug Administration ("FDA") for purposes related to the quality, safety or effectiveness of an FDA-regulated product or activity, including reporting reactions to medications or problems with products or notifying people of recalls of products they may be using; 4) disclosures to notify a person who may have been exposed to a disease or may be at risk for contracting or spreading a disease or condition; and 5) disclosures to an employer about an employee to conduct medical surveillance in certain limited circumstances concerning work-place illness or injury.
Disclosure about victims of abuse, neglect, or domestic violence - tevixMD may disclose PHI about an individual to a government authority, including social services, if we reasonably believe that an individual is a victim of abuse, neglect, or domestic violence.
Health oversight activities - tevixMD may disclose PHI to a health care oversight agency for activities authorized by law such as audits, civil, administrative, or criminal investigations and proceedings/actions, inspections, licensure/disciplinary actions, or other activities necessary for appropriate oversight of the health care system, government benefit programs, and compliance with regulatory requirements and civil rights laws.
Coroners, medical examiners, and funeral directors - tevixMD may disclose PHI to a coroner, medical examiner, or funeral director for the purpose of identifying a deceased person, determining cause of death, or for performing some other duty authorized by law.
Personal Representative - tevixMD may disclose PHI to your personal representative, as established under applicable law, or to an administrator, executor, or other authorized individual associated with your estate.
Correctional institution - tevixMD may disclose the PHI of an inmate or other individual when requested by a correctional institution or law enforcement official for health, safety, and security purposes.
Serious threat to health or safety - tevixMD may disclose PHI if necessary to prevent or lessen a serious and/or imminent threat to health or safety to a person or the public or for law enforcement authorities to identify or apprehend an individual.
Research - tevixMD may use and disclose PHI for research purposes. Limited data or records may be viewed by researchers to identify patients who may qualify for their research project or for other similar purposes, so long as the researchers do not remove or copy any of the PHI. Before we use or disclose PHI for any other research activity, one of the following will happen: 1) a special committee will determine that the research activity poses minimal risk to privacy and that there is an adequate plan to safeguard PHI; 2) if the PHI relates to deceased individuals, the researchers give us assurances that the PHI is necessary for the research and will be used only as part of the research; or 3) the researcher will be provided only with information that does not identify you directly.
Government functions - In certain situations, tevixMD may disclose the PHI of military personnel and veterans, including Armed Forces personnel, as required by military command authorities. Additionally, we may disclose PHI to authorized officials for national security purposes, such as protecting the President of the United States, conducting intelligence, counter-intelligence, other national security activities, and when requested by foreign military authorities. Disclosures will be made only in compliance with U.S. Law.
Workers' compensation - As authorized by applicable laws, tevixMD may use or disclose PHI to comply with workers' compensation or other similar programs established to provide work-related injury or illness benefits.
De-identified Information and Limited Data Sets: tevixMD may use and disclose health information that has been “de-identified” by removing certain identifiers making it unlikely that you could be identified. tevixMD also may disclose limited health information, contained in a “limited data set”. The limited data set does not contain any information that can directly identify you. For example, a limited data set may include your city, county and zip code, but not your name or street address.
Other Uses and Disclosures of PHI
For purposes not described above, including uses and disclosures of PHI for marketing purposes and disclosures that would constitute a sale of PHI, tevixMD will ask for patient authorization before using or disclosing PHI. If you signed an authorization form, you may revoke it, in writing, at any time, except to the extent that action has been taken in reliance on the authorization.
Information Breach Notification
tevixMD is required to provide patient notification if it discovers a breach of unsecured PHI unless there is a demonstration, based on a risk assessment, that there is a low probability that the PHI has been compromised. You will be notified without unreasonable delay and no later than 60 days after discovery of the breach. Such notification will include information about what happened and what can be done to mitigate any harm.
Patient Rights Regarding PHI
Subject to certain exceptions, HIPAA establishes the following patient rights with respect to PHI:
Right to Receive a Copy of the tevixMD Notice of Privacy Practices - You have a right to receive a copy of the tevixMD Notice of Privacy Practices at any time by contacting us at privacyofficer@tevixMD.com, calling us at (877) 234-4722/(877-23-HIPAA) and asking for the tevixMD HIPAA Privacy Officer, or by sending a written request to: HIPAA Privacy Officer, tevixMD, 531 South Spring Street, Burlington, NC 27215. This Notice will also be posted on the tevixMD internet site at www.tevixMD.com.
Right to Request Limits on Uses and Disclosures of your PHI - You have the right to request that we limit: 1) how we use and disclose your PHI for treatment, payment, and health care operations activities; or 2) our disclosure of PHI to individuals involved in your care or payment for your care. tevixMD will consider your request, but is not required to agree to it unless the requested restriction involves a disclosure that is not required by law to a health plan for payment or health care operations purposes and not for treatment, and you have paid for the service in full out of pocket. If we agree to a restriction on other types of disclosures, we will state the agreed restrictions in writing and will abide by them, except in emergency situations when the disclosure is for purposes of treatment.
Right to Request Confidential Communications - You have the right to request that tevixMD communicate with you about your PHI at an alternative address or by an alternative means. tevixMD will accommodate reasonable requests.
Right to See and Receive Copies of Your PHI - You and your personal representative have the right to access PHI consisting of your laboratory test results or reports ordered by your physician. Within 30 days after our receipt of your request, you will receive a copy of the completed laboratory report from tevixMD unless an exception applies. Exceptions include a determination by a licensed health care professional that the access requested is reasonably likely to endanger the life or safety of you or another person, and our inability to provide access to the PHI within 30 days, in which case we may extend the response time for an additional 30 days if we provide you with a written statement of the reasons for the delay and the date by which access will be provided. You have the right to access and receive your PHI in an electronic format if it is readily producible in such a format. You also have the right to direct tevixMD to transmit a copy to another person you designate, provided such request is in writing, signed by you, and clearly identifies the designated person and where to send the copy of your PHI. To request a copy of your PHI:
Ask for a courtesy copy when you visit a tevixMD patient service center for specimen collection.
Complete the tevixMD HIPAA Patient Request Form.
Right to Receive an Accounting of Disclosures - You have a right to receive a list of certain instances in which tevixMD disclosed your PHI. This list will not include certain disclosures of PHI, such as (but not limited to) those made based on your written authorization or those made prior to the date on which tevixMD was required to comply. If you request an accounting of disclosures of PHI that were made for purposes other than treatment, payment, or health care operations, the list will include disclosures made in the past six years, unless you request a shorter period of disclosures. If you request an accounting of disclosures of PHI that were made for purposes of treatment, payment, or health care operations, the list will include only those disclosures made in the past three years for which an accounting is required by law, unless you request a shorter period of disclosures.
Right to Correct or Update your PHI - If you believe that your PHI contains a mistake, you may request, in writing, that tevixMD correct the information. If your request is denied, we will provide an explanation of the reasoning for our denial.
How to Exercise Your Rights
To exercise any of your rights described in this notice, you must send a written request to: HIPAA Privacy Officer, tevixMD, 531 South Spring Street, Burlington, NC 27215. Except, patients may update insurance and/or billing information through our website or by contacting the Patient Billing Department using the phone number indicated on the billing invoice.

Changes to the tevixMD Notice of Privacy Practices
tevixMD reserves the right to make changes to this notice and to our privacy policies from time to time. Changes adopted will apply to any PHI we maintain about you. tevixMD is required to abide by the terms of our notice currently in effect. When changes are made, we will promptly update this notice and post the information on the tevixMD website at www.tevixMD.com. Please review this site periodically to ensure that you are aware of any such updates.
